IBAS GENERAL CONDITIONS

These Terms and Conditions for the use of the IBAS Service present a general overview of the rights, obligations and conditions for the use of the IBAS service. The same constitute the agreement between IBAS and consumers or corporates.

The User must read and confirm acceptance of these Terms and Conditions before registering to use the IBAS Service.
By creating an IBAS account, you confirm that you have read, understood and accept the Terms and Conditions of this electronic contract.

  1. Definitions
    1. IBAS - means the financial institution IBAS, which is the contracting party in this agreement;
    2. IBAS Account - means the account opened by natural persons or legal entities which enables the Client to perform the actions provided for in Article 3 of this Contract;
    3. Customer - means the natural or legal person who, based on this agreement, has an IBAS account registered in his name;
    4. Payment Transaction - means the financial action that consists of debiting the customer's account in IBAS or the related bank and crediting the account of the Merchant or other Beneficiary for the value of the goods/service;
    5. Invoices - means the institutions, organizations or similar that issue a monthly or other invoice against which you create a payment obligation;
    6. Pay - means the button through which you are directed to the option of paying for goods or services in shops, restaurants, hotels, cafeterias or any economic entity;
    7. Transfer – means a self-service space for transferring funds from your account in IBAS to the account of a natural or legal person who has an active account in IBAS;
    8. Debiting - means reducing the funds of the Client's account as a result of a transaction carried out by the Client for the benefit of the Merchant/Beneficiary;
    9. Crediting - means any incoming transaction in the Customer's account and carried out with Electronic Money;
    10. Fee - means the payment to IBAS on behalf of the cost of performing the service;
    11. Intellectual Property – means any or all patents, trademarks, industrial designs, copyrights, know-how, work flow, or other intellectual property rights, whether registered or unregistered;
    12. Personal data - have the same meaning as in Law No. 06/L-082 on Protection of Personal Data and other acts;
    13. Signature – electronic signature or SMS code/electronic identification token that meets the following requirements:
      1. exclusively owned by the signatory;
      2. is able to identify the signatory;
      3. is created and/or sent in media that the signatory can only maintain under its control; AND
      4. is linked to the data to which it is linked in such a way that any subsequent changes to the data are detectable
    14. Signatory - the person who holds the data for creating the signature and acts either on his own behalf or on behalf of the person who represents him;
    15. Authorized person - any natural or legal person that you have authorized in accordance with the legislation in force;
    16. Electronic contract - means this contract which is made in whole or in part by electronic communication or in electronic form and is binding according to LAW NO. 08/L-022 ON ELECTRONIC IDENTIFICATION AND TRUST SERVICES IN ELECTRONIC TRANSACTIONS

  2. The services that IBAS offers
    1. IBAS, a financial institution licensed by the Central Bank of Kosovo (CBK), in accordance with Law no. 03/L-209 on the Central Bank of the Republic of Kosovo, Law no. 04/L155 on the Payment System, Law No. 04/L-093 on Banks, Microfinance Institutions and Non-Banking Financial Institutions and the Regulation on the registration of IFJBs provides:
      1. Payment service to parties with whom there is an agreement such as payments to public institutions, public companies, private companies and users of the IBAS service;
      2. Money transfer service;
      3. Cash withdrawal service from IBAS or authorized partners;
      4. Granting loans for payments.

  3. Account Opening at IBAS
    1. For the use of IBAS services, the opening of an IBAS account is a prerequisite, through smartphones, with iOS or Android operating system by downloading the Application and/or using IBAS directly on the official website of IBAS. Downloading and using the Application is free of charge. An exception is made for fees charged by the mobile operator and/or internet service providers for internet usage, which do not fall under the responsibility of IBAS.
    2. IBAS offers two types of accounts: IBAS account for natural persons (hereinafter: personal account) and IBAS account for legal persons (hereinafter: organization account or business account)
    3. Opening an account at IBAS is divided into two stages:
      1. In the first phase, the following should be offered:
        1. Phone number, where the verification code will be sent by SMS;
        2. Personal Identification Number (PIN), namely its confirmation; AND
        3. The activation code that reflects the signature according to the definitions in law no. 04/L-094 For Information Society Services, or the definition in this contract .
      2. In the second stage, the identity of the Client must be verified, through verification at IBAS, where he must:
        1. Write the name and surname of the Client;
        2. Attached is a copy (photo on both sides) of the ID or passport and a snapshot (Eng. selfie);
        3. A copy of the water or electricity bill to prove the address;
        4. Copy of the business or organization certificate, if the Client is opening a business (organization) account, along with a copy of the notarized authorization certifying that the applicant is authorized to open an account.
    4. The User shall provide IBAS with any information and/or original documents that may be required by IBAS according to applicable laws and regulations, as well as other documents deemed necessary for the purpose of providing the use of the IBAS service.
    5. IBAS will offer its users 4 (four) types of account packages.
    6. By signing this contract, customers will choose one of the packages (Basic, Full, Integra or Premium), in which case they will have the following benefits

    7. Basic account (price: 0.00EUR):
      1. Issuing British IBAN (International Banking Account Number) with access to SEPA (Single European Payment Area).
      2. Filling the virtual wallet from all local or international banks directly from the bank or through the Visa or Mastercard card.
      3. Accepting and sending payments or international transfers within seconds to all countries of the European Economic Area, or to IBAS customers.
      4. All payments to public institutions.
      5. All payments to insurance companies.
      6. All payments for services, including but not limited to Electricity, Water, Waste, NPB, Internet.
      7. Withdrawal of funds to bank accounts, to IBAS partners or to individuals.
      8. Application and the possibility to be financed with credit for the purpose of making payments.

    8. PLOT account (price: 2.99EUR per month):
      1. 3.7.1 Issuing British IBAN (International Banking Account Number) with access to SEPA (Single European Payment Area).
      2. Interest-free overdraft for up to 3 (three) months for the value of up to 100 (one hundred) euros - for making customer payments. The overdrawn amount can have a maturity of up to 12 (twelve) months. If the overdraft is prepaid in full within 3 (three) months, interest will not be applied.
      3. Filling the virtual wallet from all local or international banks directly from the bank or through the Visa or Mastercard card.
      4. Accepting and sending international payments or transfers within seconds to all countries of the European Economic Area, or to IBAS clients.
      5. All payments to public institutions.
      6. All payments to insurance companies.
      7. All payments for services, including but not limited to Electricity, Water, Waste, NPB, Internet.
      8. Withdrawal of funds to bank accounts, to IBAS partners or to individuals.
      9. Application and the possibility to be financed with credit for the purpose of making payments.

    9. INTEGRA account (price: 4.99EUR per month):
      1. Issuing British IBAN (International Banking Account Number) with access to SEPA (Single European Payment Area).
      2. Interest-free overdraft for up to 3 (three) months for a value of up to 200 (two hundred) euros - for making customer payments. The overdrawn amount can have a maturity of up to 12 (twelve) months. If the overdraft is prepaid in full within 3 (three) months, interest will not be applied.
      3. Filling the virtual wallet from all local or international banks directly from the bank or through the Visa or Mastercard card.
      4. Accepting and sending international payments or transfers within seconds to all countries of the European Economic Area, or to IBAS clients. The customer benefits from 2 (two) free transactions.
      5. All payments to public institutions.
      6. All payments to insurance companies.
      7. All payments for services, including but not limited to Electricity, Water, Waste, NPB, Internet.
      8. Withdrawal of funds to bank accounts, to IBAS partners or to individuals.
      9. Application and the possibility to be financed with credit for the purpose of making payments.

    10. PREMIUM account (price: 9.99EUR per month)
      1. Issuing British IBAN (International Banking Account Number) with access to SEPA (Single European Payment Area).
      2. Interest-free overdraft for up to 3 (three) months for the value of up to 500 (five hundred) euros - for making customer payments. The overdrawn amount can have a maturity of up to 12 (twelve) months. If the overdraft is prepaid in full within 3 (three) months, interest will not be applied.
      3. Filling the virtual wallet from all local or international banks directly from the bank or through the Visa or Mastercard card.
      4. Accepting and sending international payments or transfers within seconds to all countries of the European Economic Area, or to IBAS clients. The customer benefits from 3 (three) free transactions.
      5. All payments to public institutions.
      6. All payments to insurance companies.
      7. All payments for services, including but not limited to Electricity, Water, Waste, NPB, Internet.
      8. Withdrawal of funds to bank accounts, to IBAS partners or to individuals.
      9. Application and the possibility to be financed with credit for the purpose of making payments
    11. Any overdraft approved for the customer through any package will be interest free for the first 3 (three) months only. Meanwhile, for the following months after the expiration of the 3-month period, the nominal overdraft rate in percentage of 27.00% and the effective interest rate of 20.21% will start to be applied.
    12. In accordance with paragraph 11 of this Article, the interest will start to be applied if the customer has not made the total payment of the overdraft within the period of 3 months.

  4. Transactions
    1. By opening a personal account, the Client creates the possibility of:
      1. Transfer of funds to the IBAS bank account in exchange for an amount which will be distributed or credited to your IBAS account;
      2. Accepting funds transferred from an IBAS account to your IBAS account;
      3. Payment of a periodic invoice or payments to organizations that are displayed in the "Invoices" category;
      4. Payment of goods or services to a business account, through the "Pay" button;
      5. Transfer of funds from your IBAS account to an account of another IBAS user, through the "Transfer" button;
      6. Withdrawing funds from the IBAS account in cash (Eng. CASH) through IBAS offices, agents or banks licensed by the CBK that you have an active bank account;
      7. The application for a payment loan and its acceptance, if the loan has been approved by IBAS and the disbursement and repayment contract has entered into force, either through physical or electronic signature, according to definition 1.13 of this contract ;
      8. By opening a personal account, the Client creates the possibility of:

  5. Activation, access and use of IBAS services
    1. The IBAS account will be activated and become accessible only after the verification of the Customer's identity by IBAS officials, according to the procedure stated in Article 3 of this contract.
    2. The customer can only have one individual main account with IBAS. Other accounts, e.g. savings account, etc. can be opened as a sub account. The customer also has the right to have another account in the name of the business or organization for which he holds the status of "authorized person".
    3. The Customer can also access the IBAS account through biometrics, such as fingerprints, face, voice, if they are stored on the phone. IBAS does not store them, but only uses them to access IBAS services.
    4. IBAS undertakes to implement a service only after your account has been activated and you have provided the confirmation code of the amount, the fee (if any) and the beneficiary.
    5. IBAS reserves the right to refuse the opening of a personal or business account or even suspend it if it is observed or suspected of the consumption of prohibited works, until the final decision of the Court, in accordance with the internal acts of IBAS.

  6. Acceptance of financial means from IBAS
    1. IBAS accepts the financial means, stores them in a special account, in accordance with the CBK Regulation on the storage of funds in the bank, and distributes them to the client, whenever:
      1. Transferred a sum of money through eBanking to IBAS;
      2. You have given a transfer order from your bank account to IBAS;
      3. You transferred from your debit or credit card.
    2. IBAS keeps the same amount as the equivalent of the value of physical money, its value is not changed and it is not compensated for keeping them.
    3. IBAS assures the client that the monetary means in the account are the property of the client and not the property of Ibas in accordance with article 6 of the regulation of the Central Bank of Kosovo for regulatory capital and custody of funds of IFJB clients and article 6 of the regulation of the Central Bank of Kosovo for the issuance of electronic money.
    4. The monetary means located in the client's account are protected from the demands of the IFJB's creditors, and cannot be pledged by the IFJB, are not subject to compulsory execution for the IFJB's obligations and cannot be part of the bankruptcy estate in case of bankruptcy and/or liquidation of the IFJB.

  7. Duration of holding money
    1. The money that is in your IBAS account will be valid all the time and its validity is not related to a period of time.

  8. Value for money
    1. The money transferred or kept in IBAS has the same nominal value as its physical value.
    2. IBAS will not increase or decrease their value, regardless of the duration of their retention.

  9. Withdrawal from IBAS
    1. Whenever the Client has requested the return of electronic money, IBAS is obliged to do so, without delay - within minutes, during working hours.
    2. The Client can withdraw the requested money for return to one of the offices of IBAS, authorized partners or commercial bank in which the Client has an active bank account.

  10. Inheritance of funds from the IBAS account
    1. In the event that the holder of the IBAS personal account dies and when IBAS is informed of such a thing and the death certificate is provided to prove this, all authorizations of the deceased holder will be terminated and the account cannot be used by anyone until a valid and certified decision issued by the relevant Court or Notary on who should inherit the funds from the bank account of the deceased, is brought before IBAS.

  11. IBAS service charges
    1. The customer will not pay fees for the use of IBAS services, except in the case of payments to public institutions, namely payments that pass through the State Treasury Department, acceptance of payments or transfers or withdrawal of funds from IBAS and the eventual cost of Visa, Master, Maestro card, etc. for electronic money transfer. These fees will be made known before the consumption of the service and if the Customer does not agree with the price, you will be given the opportunity to refuse.
    2. Whenever the Client does not agree with an IBAS fee, the same can refuse the consumption of the IBAS service, before confirming it and IBAS will not charge the Client with the service.

  12. Accuracy and processing of personal data
    1. The customer undertakes that the data he declares during registration in IBAS are authentic, true and up-to-date;
    2. The Personal Data of all Customers will be collected and further processed exclusively for the purposes of registration and provision of the IBAS service. IBAS will use Customer Personal Data only for the purposes of providing the service.
    3. By accepting this contract, the Client is considered to have given his/her explicit and clear consent to the collection, transfer, storage, use and processing of his/her Personal Data in the context of the use of IBAS.
    4. By accepting this contract, the Client will be deemed to have understood and voluntarily and explicitly authorizes IBAS to transmit to its service providers and/or its contractors for processing, the Clients' Personal Data, for the purposes of providing the service.
    5. By accepting this contract, the Client gives his/her explicit consent to receive communications related to the use and services provided by IBAS, by SMS and/or through other communication channels that may be available to both IBAS and the Client. The customer has the right to withdraw this consent at any time.
    6. The Customer has the responsibility to inform IBAS of any and all changes to his/her Personal Data and/or information that may affect the use of the service.
    7. IBAS and the Client will implement high-level security, technical and organizational measures that will make it possible to minimize unauthorized system interventions, changes and data losses.
    8. IBAS is responsible for fulfilling all obligations provided for in Law No. 06/L-082 for the Protection of Personal Data as well as other relevant acts for the protection of personal data.
    9. IBAS will store the Customer's data for no more than 5 (five) years after the end of this contract.
    10. If the customer applies for any of the packages that include the overdraft product, the customer accepts and declares that IBAS has the right, based on the applicable Law on Personal Data Protection and based on the CBK Regulation on Credit Registration, for the purposes of processing, connection, maintenance and amendment of this agreement, to process and use the customer's personal data, as well as to have access to the customer's credit reports in the Registry System of CBK Loans (CRK). The customer agrees that he gives this consent of his own free will and on the basis of mutual interest, and agrees that he will not deny it on any legal basis or factual event. The customer accepts and declares that he is aware that giving this consent does not automatically mean a positive response or approval of the package.

  13. Mutual obligations and responsibilities
    1. In addition to the obligations already expressed, other responsibilities of IBAS towards users are:
      1. To provide the IBAS service around the clock (24/7), unless there has been a technical breakdown or the Customer's account is subject to suspicion of illegal acts or a powerful order of the relevant authority has forced the suspension of the service;
      2. To provide security in transactions through encryption of notes and authorization of access only to own funds or to the roles defined by the authorized superior;
      3. To provide evidence of payments, printed on paper or through verification and/or download via the Internet (online);
      4. Provide you with remote technical support, after you have proven that you are the real account holder in IBAS;
      5. IBAS will not use the Customer's electronic money for any other purpose, except for eventual payments and transfers for which the Customer has given a confirmed order.
    2. Responsibilities of IBAS service users, among others, consist of:
      1. Accurate presentation of data by not intentionally providing erroneous, inaccurate information or information that causes confusion to the public;
      2. Use of IBAS only for lawful purposes;
      3. Cooperation during an investigation or not to refuse to provide confirmations regarding the requested information;
      4. Respecting the copyright and intellectual property rights of IBAS;
      5. Returning funds or notifying IBAS if funds have been deposited into the account which the Client considers should not have been in the account;
      6. Not to pay or transfer funds to another account in IBAS for the purpose of money laundering, financing of any illegal and terrorist act;
      7. Not to use IBAS services to harm other people or against public order and accepted principles of ethics;
      8. Not to disclose any password or other security mechanism to third parties and not to allow any person to use the services, except those legally authorized.

  14. Security Procedures
    1. Only one password can be linked to the Customer Account at any time and only the Customer can use the IBAS account with the corresponding username and password.
    2. The Customer is responsible for the safekeeping and appropriate use of his account, regardless of the method he chooses to use the IBAS platform (web/mobile application), for the storage and maintenance of credentials and for all Transactions to be carried out in the IBAS Account, using his credentials. The Customer is responsible for carrying out all Transactions on his account, in accordance with the provisions of this Contract.
    3. The client of IBAS has the obligation to immediately notify IBAS regarding the change of personal data.
    4. The customer must immediately notify IBAS and will provide them with all requested data related to customer verification, in the event that one of the following events has occurred:
      1. It is noted that there has been an abuse or fraudulent activity regarding his user credentials + password and that through this action third parties have gained access to the IBAS Account;
      2. Transactions were carried out without the prior approval of the Client;
      3. An error or discrepancy is noticed in the balance of the Customer's IBAS Account;
      4. The Customer's account has been destroyed, misused, lost, forged/duplicated.

    5. Record keeping and Reports
      1. IBAS will retain all records, including but not limited to bank account statements, for a period of five (5) years.
      2. The customer can request and from IBAS you will receive the report of your IBAS account which describes all the activities undertaken by you, the account balance and the amount of money available.

    6. Ways of communication between the Client and IBAS
      1. Whenever it is necessary or to implement this contract more securely, IBAS will contact the Customer on the phone number through which he created the account in IBAS.
      2. IBAS will record telephone conversations with the Client or his representative in order to increase the quality of the service.
      3. The customer can contact IBAS through the SMS integrated in the IBAS application, the phone number (038600300) and the email address info@ibas.world

    7. Development of enforcement procedures
      1. If any enforcement procedure is being developed or initiated against the Client and if, in accordance with the legislation in force, IBAS is presented with a request to block the account, IBAS is obliged to do the blocking as well as bear all the necessary expenses related to the implementation of that request.

    8. Limitation of Liability
      1. IBAS will not interfere in any way in the legal and commercial relations or legal disputes raised between the recipients of this agreement, including but not limited to personal account holders and business account holders or organization accounts.
      2. IBAS does not exercise any form of control over the compatibility, security, legality, characteristics and suitability of the products and/or services that are the object of the transaction. In this respect, it remains the responsibility of the users to obtain all the information and act with increased care before paying for the product or service or ordering any other completed transaction. IBAS is under no circumstances responsible for the non-fulfillment or irregular fulfillment of the obligation and/or the damages suffered in this respect by the Clients.
      3. The liability of IBAS towards the Clients or third parties in any circumstances is limited only to the direct damages caused by the actions of IBAS or the factors that are under the control of IBAS. In addition to the above, and to the extent permitted by applicable laws in the Republic of Kosovo, IBAS is not responsible and by accepting this agreement, Clients agree not to raise claims against IBAS for potential damages or losses, including but not limited to loss of money, good name or reputation, profit or other damages, as a direct or indirect result:
        1. Inability to use infrastructure, software or systems operated and/or maintained by IBAS or on behalf of IBAS;
        2. Delays or interruptions in infrastructure, software or systems operated and/or maintained by us or on our behalf;
        3. Viruses or harmful programs;
        4. Suspension or other actions against the Customer's account, from legal obligations.
      4. IBAS does not guarantee uninterrupted operation of operations. IBAS is committed to the maximum that the payment system operates regularly and without obstacles. However, IBAS will not be responsible for the consequences arising from irregularities in the operations system that occur due to reasons beyond IBAS's control.
      5. IBAS will not be liable to Customers for damages caused by an action or omission on the part of IBAS, if these damages arise as a result of court decisions related to it and result from the closure or suspension of your account.
      6. IBAS is not responsible if the Clients have given the access credentials to another person. Any access to IBAS through the telephone number and PIN selected by the Client or signs is deemed to have been carried out by the Client himself or his authorized person, whose actions cannot be denied.

    9. Severability and nullity of provisions
      1. If one or more provisions of this agreement are considered null and void by the competent institution, this will not affect the validity of the contract as a whole and the other provisions will remain in force.

    10. Complaint procedure
      1. In case of potential dissatisfaction, IBAS has foreseen the mechanization of complaint for various issues related to the use of IBAS services. The ways of filing a complaint are through:
        1. Postal letters;
        2. Email ankese@ibas.world
        3. Call the customer service number 038600300;
        4. In person at the IBAS offices;
      2. Complaints must be dealt with promptly. Each complaint will be evaluated and the decision on the complaint will be made and communicated to the Complainant within a maximum period of fifteen (15) days from the day of receipt of your complaint.
      3. Any extension beyond the fifteen (15) day limit must be approved by the complaints handling manager within IBAS and a separate record will be kept in the database. Regarding the postponement in question, IBAS will immediately inform the Complainant in detail about the reasons for the postponement as well as the date when the decision on the complaint submitted by you will be communicated.
      4. The general duration of the postponement cannot exceed thirty (30) days, except in special cases, which due to their complexity require additional time which must be approved by the general director or his/her deputy for those cases where the extension of the deadline is allowed by the laws in force.
      5. In case of dissatisfaction with the decision taken, the Appellant has the right to appeal to the IBAS Board of Directors, within a period of fifteen (15) days from the day of the decision.
      6. In the event that the Complainant considers that the decision of the IBAS Board of Directors does not give the deserved answer regarding his/her claims or that his/her claims have been rejected or rejected, then the Complainant can turn to the Central Bank of Kosovo within fifteen (15) days from the day of receiving the last decision.

    11. Intellectual property
      1. The IBAS platform is developed by PBC and the same holds all intellectual property rights, including copyright.
      2. Copying or reproduction of business logic, workflow or any part is strictly prohibited.
      3. Any use of copyright may only be made with the written permission of the copyright owner.

    12. Applicable law
      1. The interpretation of this agreement will be based on the laws applicable in the Republic of Kosovo.

    13. Amendment of Agreement
      1. In case of amendment of the terms and conditions of this agreement, IBAS will notify the Client of the proposed amendment of this agreement one (1) month from the effective date.
      2. The customer has the right to terminate this agreement if he is not satisfied with the amendments made, within the time period provided in the above paragraph, without any penalty or additional costs.
      3. If the Client does not object to the amendment of the agreement within the period of one (1) month, i.e. before the amendments to this agreement enter into force, IBAS will consider that the Client has agreed to the new conditions according to the amendment. From the moment of entry into force of the amendments, the contractual relationship between the Client and IBAS will be governed by the amended version of this agreement.

    14. Conflict resolution
      1. Any dispute relating to this agreement, including disputes as to its existence, validity, breach or termination, shall be resolved amicably through negotiations and discussions between you and IBAS.
      2. Disputes that cannot be resolved amicably will be resolved by the competent Court in Pristina.

      1. Account closure
        1. Upon the Customer's request, IBAS will close the account within five (5) business days, from the last date of withdrawal of all funds in the Customer's account.
        2. The customer cannot close an account if there are outstanding obligations to IBAS.
        3. In accordance with the applicable legislation IBAS may suspend, limit or terminate, in whole or in part, the provision of the IBAS Services and/or close the Client's Account without informing him and/or without any obligation whatever the possible actions to inform the Client that this action has been taken or will be taken) in the following circumstances:
          1. if IBAS understands or has reason to believe that the Customer's phone number or password for use of the IBAS Services is being or has previously been used in an unauthorized, illegal, inappropriate or criminal activity;
          2. if the Customer fails to comply with the requirements of this Agreement in relation to the IBAS Services;
          3. if the Customer reports that the mobile device is lost or stolen or the password is lost;
          4. for reasons beyond the control of IBAS, including but not limited to force majeure, measures of the relevant regulatory bodies or changes in legislation.

      2. Termination of Agreement
        1. The agreement between the Client and IBAS is concluded for an indefinite period of time and enters into force at the moment the Client presses the "Accept" button.
        2. The customer may terminate the agreement, after giving written notice of termination of thirty (30) days. IBAS also reserves the right to terminate the agreement unilaterally, upon sixty (60) days' written notice of termination.
